Payment terms under 90 days
Payment in 3 or 4 instalments, with or without charges for the customer, is considered a payment facility. The first payment is made at the time of purchase, which means that 3 monthly instalments remain to be paid for a payment in 4 instalments.
Under 90 days, this method of payment is not considered consumer credit. None of these rules therefore apply. However, the customer is still obliged to repay the monthly instalments.
Buyers who opt for a fractional payment method are not required to provide proof of income or identity. The transaction is quick and easy for both customer and seller. Fees are at the discretion of the company offering deferred payment.
Credit from 4 monthly instalments
For payment in instalments of more than 4 months, the rules in force are those for consumer credit. For example, if you wish to pay in 10 or 12 instalments, you will benefit from additional rights, but also obligations, as you undertake to repay the instalments in full before the end of the credit period.
As with any offer of credit, the merchant must provide the customer with a pre-contractual information sheet setting out the payment schedule and credit rate (TAEG).
Once signed, this form acts as a contract. The customer then has a cooling-off period of 14 calendar days from signing the credit offer.
